You do not know what you do not know

As you are first exploring your options, you do not really know what your options are or where to start.

For instance, you are looking to expand your business operations to the UK. You are not able to appreciate the best options that may be available to you or how to approach the market as the very first step.

You are not sure what is the best way to sell and what is the regulatory framework that you need to be aware of.

Perhaps, the most surprising outcome is to acknowledge that it is a very specific market and what may work in your home country or elsewhere in the world is not the same in the UK.

Making the first good step

You may be looking at many different options available to you, but you are not sure what is the next best step for you.

For instance, you are currently in the UK on a student visa, but would like to remain here longer and potentially, gain work experience while in the UK.

Applying for a graduate visa may be perfect for you as it will allow you to gain work experience in the UK with any employer as they do not need to have the sponsor licence to sponsor you.

The fear is always the greatest in the dark

You may be looking at the requirements that may scare you, but do not really apply to you or you are looking at solutions that are not right for you.

For example, you are based overseas while your family member is now living in the UK.

Your family member wants to buy their first home in the UK and apply for a mortgage. You want to help and support your family members. 

You want to send funds to increase the size of the initial payment deposit, but you are worried that by sending money to your family based in the UK will increase their UK tax liability because of the UK Inheritance tax rules.

As we speak, I am able to confirm that your family member has not been living in the UK long enough for the inheritance tax to apply.

I also offer to prepare a tax opinion and keep the tax assessment record should HMRC reach out and need any specific clarifications.

Everything is always changing – nothing is the same

A client recently reminded me that their circumstances were well-known in advance before they came to me and applied for their initial tax planning sessions with me. 

Unfortunately, I had to remind my client that nothing remains still and everything is changing. I always encourage my clients to monitor the advice received against the developing changes.

It is also the ability to retain all the relevant details over the time. Sometimes, there is only so much information that could be retained throughout time and our ability to focus.

Plan ahead

As I work with my clients it is important to test ahead of time to see based on the clients’ circumstances and evidence available whether the application is going to be successful.

I always encourage clients to reach out to me at least 6 months in advance before the application for the indefinite leave to remain or the renewal for the limited leave to remain falls due.

Personal circumstances may change fairly quickly. At all times it is important to determine the decisions that you are going to make during the next couple of months, how they are going to affect your application.

It is also timely to revisit the type of evidence you have available and whether you need to identify the additional sources of required evidence in order to satisfy the criteria for the application to be successful.
